Should gambling winnings really be counted as income for tax purposes?

Sure some gambling games have some degree of skill but there's plenty of luck as well. And some games are just pure luck. It's as if you randomly found $100 on the ground and the government came along and wanted to take some as "income".
Plus it distorts the tax code as you can also file for deductions in the case of gambling losses. I just feel if you win $500 or $1000 or whatever amount you should be able to keep of all it. And if you lose $500 or $1000 then you lose all of it. Plus just imagine how much it would increase tourism to cities like Las Vegas.

ELI5: Why does the U.S. government tax us on income that they have no way of knowing about? This includes gambling winnings, tips, etc. How can they even enforce such a tax?

How can the government enforce a tax on money that they have no way of knowing about? If I win a large sum of money off of Saturday night poker night, then that's obviously part of my gross income, but the government has no way of knowing about that money or enforcing a tax on it. How does this still happen? What about tips in the restaurant business? Most are cash handed from one person to the other, with no documentation at all. And yet servers are required to not only keep track of their tips, but to report them to be taxed on them. Could someone enlighten me?

I filed my taxes and.....

Well, I’ve seen a ton of posts on here recently about taxes. Everyone arguing about who is right, who is wrong. The constant “that’s dumb. Nobody would gamble if they did taxes like that”.
Well, I filed my taxes last night. Everyone saying that you report total winnings as income and report losses as a deduction is correct. You do NOT claim net winnings. I don’t care if “FanDuel’s app says net winnings”.
I used Credit Karma to file. In the income section it specifically states “Gambling Winnings (excluding losses)” in the deductions section, it asks for “Gambling Losses”. This is where you report your losses.
So, if you won $5k, you report all $5k as income. If you lost $4500, you report that in deductions. You will then pay taxes on the $500 net profit if you can itemize.
YOU DO NOT PUT $500 IN THE INCOME SECTION.
As we all wondered, unless you have enough deductions to actually itemize, you’re stuck paying taxes on all of the winnings and your losses get lumped into the standard deduction.
Not here to argue or get into “dude, you’re wrong and stupid” back and forth. I’m not wrong, I’m correct. If you do not believe me, file however you would like to and hope the IRS does not come knocking.

CreditKarma Follow Up - Gambling Winnings Vs. Losses

On the recent thread, JustASalesGuy22 said that he could put in his total gambling winnings in the "Gambling Winnings" section of CreditKarma and then go to the Deductions page and put in the losses. When I go to the Gambling winnings page, the only thing it asks for is information for a W2-G. I've tried flipping from the standard deduction to itemized and it does not change. CreditKarma support also had no relevant advice.
Has anyone else been able to enter winnings without the W2-G requirement?
(I tried reaching out and replying in the original thread, but never received a response for help, which is why i'm opening it to the group. Also, I am just exploring the numbers right now, not finalizing a file so save the see a professional as I will still be considering that.)

Sports Betting Tax Advice from my CPA

Yes, this is another tax thread. These are the direct answers I received from my CPA who has 25+ years of experience filing for gamblers, both professional and not. Don't shoot the messenger.
Do I report winnings gross or net? Surely net, right? Right!??
Winnings are reported on a gross amount. If you open an app and it shows a ledger of $30,000 winnings, $28,000 bets wagered, Win/Loss $2000, the IRS needs the $30,000 number. The $28,000 gets reported on a Schedule A under gambling losses, and only factors into your net tax liability if you itemize.
But isn't sports betting on an app just one long session? I don't pay taxes on every hand of blackjack I win.
No. Unfortunately this matter relies on case law, for which the precedent for online gambling is an "every bet is a session" accounting.
So if I don't itemize and I have huge gross winnings, that means I could owe thousands in taxes?
Yes. If you have thousands in gross winnings and didn't plan to itemize, you will essentially owe taxes on the difference between your standard deduction and your pre-gambling itemized tax amount when switching to an itemized gambling loss deduction.
If I report net winnings instead of doing it by the book, what are the odds I get audited?
Almost zero. Obviously my CPA didn't advise me to do this, but of the thousands of filings she had done in her career, she has only had 3 audits, and all of them were due to inconsistencies on a Schedule C filed only by professional gamblers. She also said that due to COVID delays, the odds of getting audited are even smaller.
Are there any other hidden downsides to having an inflated Adjusted Gross Income when I have gross winnings of tens of thousands of dollars?
Yes. Student loan interest deductions and child tax credits go away at certain AGI.
On the state tax side, she said certain states don't allow ANY deduction for gambling losses on state taxes. I.e. if you live in IL, you probably just shouldn't ever gamble. Every bet you win comes with a 4.95% tax on gross winnings. If your state doesn't allow gambling loss offsets, there is no limit to what you could owe regardless of your year-end profitability.

Hi guys,
I have a quick question about taxes for sports gambling winnings/losses this year.
Assume I live in Illinois (which is true) and my income from last year and this year is the same with all other factors remaining constant as well - # of dependents, no short stock gains, etc.
Assume last year with my same salary and situation that I received $3k back in taxes.
If for the year of 2020 I had $100k in winnings and $105k in losses and I itemize those losses, should I still be receiving $3k back in taxes for the year?

Which country in Europe do you recommend for online poker?

I currently live in Spain. The current situation for online poker here has the upside that it's perfectly legal, but it has the downside of only allowing you to play vs people in Spain, France or Portugal. I'm interested in moving to another country and would appreciate your experience with poker in different countries across Europe. Specifically I'd like to know if you have access to the global player pool (the .com license) from your country, if it's also a smaller pool like in Spain, or if it's not legal at all.

I am new to winning at poker and need help with my tax situation for this year. I won a little over six figures this year in rakeback/winnings on pokerbros, but I don’t know how I’m supposed to report it. Most of the money I have kept on PayPal/cash app/apple pay, but I’ve made about 40k worth of deposits to my actual bank accounts. I didn’t keep daily gambling journals like I’ve now read I was supposed to, and some of the clubs I won in don’t exist anymore so there’s no way for me to go back and find all of the records from each game I’ve played in. All I have are the deposit/payout transactions I’ve made in PayPal/cash app/Apple Pay to track my total winnings. Can I use these to report my winnings? What am I supposed to do? Hello I have a question about those who have reported profit with taxes from sportsbetting/daily fantasy. I currently use fanduel/draftkings/pointsbet sportsbook and are profitable on 1 app and down on the others. Up 5k on pointsbet/down 2k on draftkings/down 300 on fanduel. When you report do you report what your up/down in total or only on the app that you are $600+ profit on. So will I have to pay taxes on 5k(Pointsbet profit) or 2.7k(Pointsbet-draftkings-fanduel profit). I usually use bitcoin sportsbook but these usa apps make it so much easier now.

For the first time in my 13 years of filing taxes, I OWE MONEY. I'm hoping there's something I'm missing here... Please help!

According to TurboTax I owe $2600 in taxes this year. I made $22,500 via W-2s for three different serving jobs (1 in VA and 2 in CA) and $19,250 via unemployment (which was not taxed.) How the fuck am I supposed to pay $2600?!
I file individually with 1 allowance. I earned income in Virginia and California. I have no children, do not own a house, have not made substantial donations to charity, have no assets other than my 14 year-old car, do not have any investment accounts/crypto currency/stocks/retirement funds, did not receive any 1099 income (besides the unemployment) or gambling winnings, have no student loan debt, and am not blind/native/a victim of natural disastea student/etc/etc/etc.
In Virginia, servers earn wages of $2.13 an hour. We also claimed 100% of our tips at the restaurant where I worked. I never received a paycheck because my wages all went to taxes... however it still wasn't enough to cover the spending spree Uncle Sam has gone on on my behalf. So there's THAT.
Yes, I was stupid not to tick the little box that tells the state of Virginia to withhold taxes from my unemployment checks. No, I did not think that I was going to receive them for 6 months... Or that I would only be able to go back to work for 2.5 months before getting furloughed when my state shut down again 😑.
I'm also baffled over how anyone could believe that an unemployed person could cover the tax on their unemployment.
ANYWAY. I don't qualify for the EIC or any other obvious tax breaks and now I'm staring down the barrel of an insane tax bill that is 7 times my current net worth. Am I missing something that would make this number not so scary??

My story is a long one and gets crazy and need to vent .. I appreciate whoever takes the time to read ... I'm currently 26 it all started about 5 years ago .. my wife ( fiance at the time ) took me to my first casino trip . I had never been .. were a lower class family have 4 kids and don't make much together but we get by , we went with our income tax check took half of it around 4k ... I found myself in a high roller room betting 50$ dollar spins on Vgt Slots and I hit my first jackpot for 12k ... It was amazing .. after taking my i.d and ss info signed a few paper work 10 minutes later they came and handed me a w-2 and 12 K ALL IN CASH ! Tbh it's the most cash I ever seen in my life and from that moment on I WAS HOOKED ... I took that money and kept playing ended up even winning more Jackpots around 30K in total when all was said and done that weekend ... Never had all this much money in my hands at once .. I had so much luck couldn't believe it .. I did nothing smart with the 30k , I ended up putting down a 15k down payment on a nice used chevy tahoe ( I COULD OF BOUGHT IT AND OWNED IT FOR 22K !) But I WANTED MORE MONEY TO GAMBLE ) I put down that huge down payment and got hit with huge interest and a high monthly payments for 4 years ( lost the truck 2 years latter due to only 2 missed payments ) the rest of the money I had I went back to the casino with chasing more Jackpots and lost it all !! Fast forward 5 years later I've won a total of around 150k in jackpots have never paid taxes on none of them ! Ive never filled taxes before all the jobs I have have been hard labor and under the table .. I worry about how much I owe in taxes but I still gamble to this day... Every year since that year we take half our income tax and go up there and bet on high roller slots 25 to 100$ dollar spins ! and end up loosing it all !.. my wife who is a waitress sometimes makes extra money on a lucky day and instead of saving a dollar it's all spent right at the casino ! The cannabis market right now is so similar to the start of the green energy market.. its nowhere near done being bullish.
